Terms of Service for Travel Data-Only (internet) eSIMs

1. Introduction

Welcome to AirSims.com.au ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our travel data-only eSIM services ("Service"). By purchasing, activating, or using our eSIMs, you agree to these Terms. Please read them carefully.

2. Service Description

  • Travel Data-Only (internet) eSIMs: Our eSIMs provide data (internet) connectivity only and are designed for use while traveling internationally. They do not include voice (standard voice calls) or text (SMS, MMS) services unless specified otherwise.
  • Activation: eSIM activation details will be delivered electronically via email or your account on our platform. Activation is subject to compatibility with your device and network coverage.

3. Usage and Restrictions

  • Permitted Use: Our eSIMs are intended for personal use only. Unauthorized commercial use, reselling, or distribution of the eSIMs is prohibited.
  • Data Limits: The eSIMs come with specific data limits as outlined in your purchase plan. Exceeding these limits may result in reduced speeds for Unlimited plans. Plans with set data limits will cause the service to stop once limit has been reached. 
  • Device Compatibility: Ensure your device is compatible with eSIM technology and supports the network coverage in your travel destination.

4. Activation and Service

  • Activation: You are responsible for providing the correct contact information, email address and checking your inbox, spam/junk email folders. You are responsible for activating the eSIM according to the instructions provided. Activation must be completed before the start of your travel to ensure connectivity.
  • Service Availability: Our eSIMs rely on third-party network providers in the host country. We do not guarantee uninterrupted service or network coverage in all locations. The eSIM may not be a reliable method of communication in emergencies due to factors beyond our control, including but not limited to network issues, natural disasters, government intervention, states of emergency, civil unrest, war, local outages, and extended power disruptions. These factors can impede connectivity and render communication services unavailable when they are most needed.

5. Fees and Payments

  • Charges: The price of the eSIM and any applicable fees will be specified at the time of purchase. There are no additional charges once your limit is reached.
  • Refunds: Refunds are subject to our Refund Policy. Please review it for details on eligibility and request procedures.

6. User Responsibilities

  • Accurate Information: Provide accurate information during purchase and activation to avoid issues with service delivery.
  • Device Security: Maintain the security of your device and account credentials. We are not liable for unauthorized use of your eSIM or account.
  • Compliance: Use the eSIM in compliance with all applicable laws and regulations. Unauthorized activities such as illegal data usage or network abuse are prohibited.

7. Limitations of Liability

  • Service Disruptions: We are not liable for any service disruptions, delays, or issues arising from network provider failures or other external factors.
  • Data Loss: We are not responsible for any data loss, including loss of personal information or communications, resulting from the use of our eSIMs.
  • Indirect Damages: We are not liable for any indirect, incidental, or consequential damages arising from the use or inability to use our eSIMs.

8. Termination and Suspension

  • Termination: We reserve the right to terminate or suspend your access to the eSIM service if you violate these Terms or engage in activities that disrupt service or breach network provider agreements.
  • Suspension: Service may be temporarily suspended for maintenance, upgrades, or other reasons. We will endeavour to minimize disruption and provide notice where possible.

9. Changes to Terms

  • Modifications: We may update these Terms from time to time. Changes will be posted on our website, and the updated Terms will apply to all future transactions.
  • Notification: Continued use of the eSIM service after changes are posted constitutes acceptance of the revised Terms.
